OVERVIEW
The Sananda Maitreya Official Store and this website are operated by TreeHouse Publishing S.r.l.
Throughout these Terms of Service, the terms “we”, “us” and “our” refer to TreeHouse Publishing S.r.l. The term “Store” refers to the Sananda Maitreya Official Store. The terms “website” and “Service” refer to this website, its functions and the physical products, digital content and services offered through it.
Our details are:
TreeHouse Publishing S.r.l.

VAT number: IT08797000968
Email: merchandise@sanandamaitreya.com
Our e-commerce platform is provided by Shopify Inc. and its affiliated service providers.
These Terms apply to your access to the website and to purchases made through the Store. They should be read together with our Refund Policy, Shipping Policy, Privacy Policy, Cookie Policy and any product-specific conditions displayed before purchase.
Nothing in these Terms excludes or limits mandatory consumer rights available under applicable law.
SECTION 1 — ACCEPTANCE OF THESE TERMS
By accessing the website, creating or accessing a customer account, or placing an order, you agree to these Terms to the extent applicable to your use of the Service.
If you do not agree to these Terms, you must not place an order or use any part of the Service that requires your acceptance.
The version of the Terms in force when an order is accepted will normally apply to that order.
SECTION 2 — ELIGIBILITY
To place an order, you must:
• be legally capable of entering into a binding contract;
• be at least the age of majority under the law applicable to you, or act with the permission and supervision of a parent or legal guardian;
• provide accurate and complete information; and
• use an authorised payment method.
Products purchased through the Store are intended primarily for personal use.
We may restrict or reject orders that reasonably appear to be placed for unauthorised resale, fraudulent purposes or other unlawful commercial activity.
SECTION 3 — CUSTOMER ACCOUNTS
Shopify Customer Accounts allow customers to view and manage orders and, where available, submit eligible return and cancellation requests.
Customers sign in using the email address associated with their order and Shopify’s passwordless email-verification process. Prior password-based account registration is not required.
You are responsible for:
• providing accurate account information;
• maintaining access to the email address associated with your account;
• protecting your account and devices from unauthorised access; and
• notifying us promptly if you suspect unauthorised activity.
We may suspend or restrict an account where reasonably necessary to protect the Store, investigate suspected fraud, comply with legal obligations or address a material breach of these Terms.
SECTION 4 — PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, dimensions, formats, track listings, colours, availability and prices are accurate.
Product images are provided for illustration. Colours and visual details may vary depending on lighting, screen settings, manufacturing batches and the characteristics of the product.
Minor variations that do not materially affect the product’s identity, quality or intended use do not necessarily constitute a lack of conformity.
Product availability may be limited. Limited-edition products are not guaranteed to be restocked or reproduced.
Any material compatibility or technical requirements for digital content will be displayed on the relevant product page or during checkout where applicable.
SECTION 5 — PRICES, TAXES AND CUSTOMS
Prices are displayed in the currency selected on the Store or determined by the customer’s location.
Applicable taxes and delivery charges will be displayed during checkout before the order is submitted, where technically and legally possible.
For deliveries outside the country or customs area from which a product is shipped, import VAT, customs duties, handling charges or other local taxes may be imposed by the destination country.
Unless checkout expressly states that these amounts are included, the recipient is responsible for import duties, local taxes and customs charges imposed by the destination country.
We do not control these charges and cannot predict their amount.
SECTION 6 — ORDERS AND CONTRACT FORMATION
By submitting an order, you make an offer to purchase the selected products under these Terms.
An automatic order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.
For physical products, the contract is normally concluded when we send a dispatch or order-acceptance confirmation.
For digital content, the contract is normally concluded when we confirm the order and make the content available for download, streaming or account access.
Where an order contains several products, acceptance may occur separately for each product.
We may decline or cancel an order before acceptance for reasonable grounds, including:
• product unavailability;
• an obvious pricing or description error;
• failure or refusal of payment authorisation;
• suspected fraud or unauthorised use of a payment method;
• applicable trade, sanctions or legal restrictions;
• delivery being unavailable to the supplied address; or
• breach of a disclosed purchase or quantity limit.
If we cannot accept an order after payment has been collected, we will refund the amount collected without undue delay.
SECTION 7 — PAYMENT
You agree to provide current, complete and accurate billing and payment information.
Payments are processed by Shopify and/or the payment providers shown during checkout.
You confirm that you are authorised to use the selected payment method.
Your payment method may be authorised when you place the order and charged in accordance with the information displayed during checkout and the applicable payment provider’s terms.
SECTION 8 — PHYSICAL PRODUCTS, SHIPPING AND DELIVERY
Physical products are shipped to the delivery address supplied during checkout.
Available delivery methods, charges and estimated delivery times are displayed during checkout or described in our Shipping Policy.
Delivery and transit times are estimates unless we have expressly agreed to a guaranteed delivery date.
We are not responsible for delays caused by events outside our reasonable control, customs authorities or incomplete or inaccurate delivery information supplied by the customer. This does not affect mandatory consumer rights relating to delayed delivery.
Risk of loss or damage to physical goods passes to a consumer when the goods are physically received by the consumer or by a third party designated by the consumer other than the carrier, except where applicable law provides otherwise.
Ownership of physical goods passes after full payment has been received.
SECTION 9 — DIGITAL CONTENT
Digital products may include MP3 files, digital albums, digital sheet music and other downloadable or streamable content.
Digital content is normally supplied immediately after purchase through a download link, email, account access or another electronic delivery method.
Before immediate supply begins, customers with an applicable statutory right of withdrawal will be asked to:
• expressly consent to the supply of the digital content before the end of the withdrawal period; and
• acknowledge that the right of withdrawal will be lost once downloading, streaming or access begins.
This consent and acknowledgement will be collected through a separate, affirmative action during checkout and may be confirmed in the order confirmation.
Once downloading, streaming or access begins following the required consent and acknowledgement, the digital content cannot be cancelled or refunded solely because the customer has changed their mind.
Digital products may be designated as final-sale items in Shopify’s self-service return and cancellation rules. As a result, these products cannot normally be selected through the self-service portal.
The Shopify designation is an administrative setting and does not exclude mandatory legal rights.
If digital content has not been supplied, is defective, corrupted, inaccessible, incorrect, incompatible with disclosed technical requirements, materially different from its description or otherwise not in conformity with the contract, the customer must use the Return Assistance form or contact merchandise@sanandamaitreya.com.
You are responsible for ensuring that your device, software, internet connection and available storage meet any technical requirements disclosed before purchase.
SECTION 10 — DIGITAL-CONTENT LICENCE
Unless the relevant product page expressly states otherwise, purchasing digital content grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use it for private, non-commercial purposes.
The purchase does not transfer ownership of any copyright or other intellectual property rights in the music, recordings, compositions, artwork, sheet music, files or related materials.
Except where expressly permitted by law or authorised by us in writing, you must not:
• reproduce or distribute the content to third parties;
• upload it to file-sharing platforms or public repositories;
• resell, sublicense, rent or commercially exploit it;
• remove copyright, attribution or rights-management information;
• use it for commercial synchronisation, broadcasting or public distribution; or
• make it available for unauthorised downloading or streaming.
Public-performance, broadcast, synchronisation, mechanical-reproduction or commercial-use rights must be obtained separately from the relevant rights holders or collecting societies where required.
SECTION 11 — SEALED AUDIO AND VIDEO RECORDINGS
Physical audio and video products may include CDs, DVDs, vinyl records and other sealed recordings.
Where applicable law provides a right of withdrawal, that right is excluded once the original seal, wrapping or security packaging of a sealed audio or video recording has been removed or broken after delivery.
This does not affect statutory rights where a physical recording is defective, damaged, incorrect, incomplete or otherwise not in conformity with the contract.
SECTION 12 — RETURNS AND SELF-SERVICE REQUESTS
Eligible return and cancellation requests may be submitted through the “Request a Return” link displayed in the footer of the website.
Customers must sign in using the email address associated with the relevant order and follow the instructions provided in their Shopify Customer Account.
Customers who cannot use the self-service portal may submit their request through the “Return Assistance” form or contact merchandise@sanandamaitreya.com.
The self-service portal does not replace or restrict any statutory right to communicate withdrawal through another clear statement permitted by applicable law.
Self-service return requests are reviewed before return instructions are issued. However, a valid statutory withdrawal does not depend on our discretionary approval.
Returns, withdrawals, exchanges, cancellation requests, return shipping costs and refunds are governed by our Refund Policy.
SECTION 13 — ORDER CANCELLATIONS
Customers may submit a self-service cancellation request for an eligible physical product while it remains unfulfilled.
A cancellation request does not guarantee that an order can be stopped. We may be unable to cancel an order where processing, personalisation, packing or dispatch has already begun.
If the physical order has already been dispatched, the customer may exercise any applicable return or withdrawal rights after delivery.
Digital products are normally excluded from self-service cancellation requests because they are supplied immediately and are designated as final-sale items in Shopify’s return rules.
Where digital supply has not begun and an applicable cancellation or withdrawal right remains available, the customer may contact us through the Return Assistance form or by email.
SECTION 14 — CUSTOM AND PERSONALISED PRODUCTS
Products made to the customer’s specifications, clearly personalised or manufactured as a special order may not be covered by a statutory right of withdrawal or our voluntary return policy.
This exception does not affect rights relating to defective, damaged, incorrect or non-conforming products.
SECTION 15 — LEGAL GUARANTEE AND CONFORMITY
Nothing in these Terms limits any mandatory legal guarantee or conformity rights.
Eligible consumers benefit from the statutory legal guarantee applicable to consumer goods and digital content.
Where a product or digital item is defective, incorrect, not as described or otherwise not in conformity with the contract, the customer may be entitled to the remedies provided by applicable law.
Any commercial guarantee or voluntary return policy offered by us exists in addition to, and does not replace, statutory consumer rights.
SECTION 16 — SALE ITEMS, PROMOTIONS AND BUNDLES
Sale and promotional products remain covered by applicable statutory rights.
Products may be excluded from our additional voluntary return policy only where this is clearly disclosed before purchase and permitted by applicable law.
Promotional codes and discounts:
• must be used in accordance with their stated conditions;
• have no cash value unless required by law;
• cannot normally be combined unless expressly stated; and
• may be cancelled where obtained or used fraudulently.
Where products are sold as a bundle or multi-product offer, product-specific conditions may require the complete bundle to be returned.
Where a partial return is permitted, the refund may be calculated by reasonably allocating the discount among the products included in the offer.
SECTION 17 — INTELLECTUAL PROPERTY
The website and its content, including text, graphics, photographs, artwork, logos, music, audio, video, compositions, recordings, product names, design, code and downloadable materials, are owned by or licensed to TreeHouse Publishing S.r.l. and/or the respective rights holders.
All rights are reserved.
You may use the website only for personal and lawful purposes.
You must not copy, reproduce, modify, distribute, publish, transmit, commercially exploit, scrape or create derivative works from website content without prior written authorisation, except where permitted by mandatory law.
“Sananda Maitreya” and related names, images, artwork and branding may be protected by copyright, trademark, personality, publicity and other rights.
SECTION 18 — USER CONTENT, REVIEWS AND SUBMISSIONS
Where the website allows you to submit reviews, comments, photographs or other content, you confirm that:
• you have the right to submit that content;
• it does not infringe another person’s intellectual property, privacy, publicity or other rights;
• it is not unlawful, fraudulent, defamatory, threatening or abusive; and
• it does not contain malware or harmful code.
You retain ownership of your original content.
By submitting content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and communicate that content for the purposes of operating, promoting and improving the Store, subject to applicable privacy law.
We may remove content that violates these Terms or applicable law.
SECTION 19 — PROHIBITED USES
You must not use the website or Service:
• for any unlawful or fraudulent purpose;
• to infringe intellectual property, privacy or other rights;
• to transmit malware, viruses or harmful code;
• to interfere with the website’s security or operation;
• to gain unauthorised access to accounts, systems or data;
• to collect personal data unlawfully;
• to impersonate another person;
• to submit false or misleading information;
• to conduct unauthorised scraping or automated extraction; or
• to circumvent purchase, territorial, download or security restrictions.
We may restrict access where reasonably necessary to prevent or investigate prohibited activity.
SECTION 20 — THIRD-PARTY SERVICES AND LINKS
The Store may use or link to third-party services, including payment providers, delivery companies, social networks, streaming platforms and external websites.
We do not control independent third-party websites and are not responsible for their content, availability or separate privacy practices.
Your use of a third-party service may be subject to that provider’s own terms.
Nothing in this section limits our responsibility for third parties acting on our behalf where applicable law makes us responsible.
SECTION 21 — PRIVACY AND COOKIES
Our processing of personal data is described in our Privacy Policy.
Our use of cookies and similar technologies is described in our Cookie Policy and managed through the cookie-preference tools available on the website.
SECTION 22 — WEBSITE AVAILABILITY
We aim to keep the website and Service available and secure but do not guarantee that access will always be uninterrupted or error-free.
We may temporarily suspend or modify parts of the Service for maintenance, security, technical, legal or operational reasons.
This does not affect obligations relating to digital content already purchased or mandatory consumer remedies.
SECTION 23 — ERRORS AND CORRECTIONS
We may correct typographical errors, technical errors, inaccurate descriptions and other mistakes on the website.
If we identify a material pricing or description error before an order is accepted, we may contact the customer and offer the option to proceed under the corrected conditions or cancel the order.
Corrections will not remove or reduce rights relating to an order already validly accepted, except where permitted by applicable law or agreed with the customer.
SECTION 24 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:
• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• wilful misconduct or gross negligence where applicable;
• breach of mandatory consumer rights; or
• any other liability that cannot lawfully be excluded.
For consumers, we are responsible for losses that are a foreseeable consequence of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
Products and digital content sold through the Store are intended primarily for personal use. To the extent permitted by law, we are not responsible for business losses, lost profits, lost revenue, lost business opportunities or loss of commercial data arising from consumer use of the Store.
Nothing in this section affects statutory rights relating to defective or non-conforming goods or digital content.
SECTION 25 — EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, strikes, transport disruption, customs delays, telecommunications failures, cyber incidents, governmental action, war, civil disorder or public-health emergencies.
We will take reasonable steps to minimise the effects of such events and comply with mandatory rights relating to delayed or impossible performance.
SECTION 26 — SUSPENSION AND TERMINATION
We may suspend or terminate access to the Service where reasonably necessary because of:
• a serious or repeated breach of these Terms;
• fraudulent or unlawful activity;
• a security risk;
• non-payment; or
• a legal or regulatory requirement.
Termination does not affect rights and obligations that arose before termination, including payment obligations, licences, intellectual property provisions and statutory consumer rights.
SECTION 27 — GOVERNING LAW AND JURISDICTION
These Terms and contracts concluded through the Store are governed by Italian law.
If you are a consumer, this choice of law does not deprive you of the protection provided by mandatory provisions of the law of the country in which you habitually reside, where those provisions apply.
Consumers may bring proceedings before any court that has jurisdiction under applicable consumer-protection and private-international-law rules.
For customers acting exclusively in the course of a trade, business or profession, the courts of Milan, Italy, will have exclusive jurisdiction unless otherwise required by mandatory law.
SECTION 28 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Service, our practices, technology or applicable law.
Material changes will apply prospectively from the date stated in the updated Terms.
Changes will not retroactively alter an order already accepted unless required by law or expressly agreed with the customer.
SECTION 29 — SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.
The remaining provisions will continue in effect.
SECTION 30 — NO WAIVER
If we delay or fail to enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.
SECTION 31 — ENTIRE AGREEMENT
These Terms, together with the policies and product-specific conditions referenced in them, constitute the agreement governing use of the Store and purchases made through it.
Nothing in this section limits representations or information that form part of the contract under mandatory consumer law.
SECTION 32 — CONTACT INFORMATION
